## 1. INTRODUCTION AND PARTIES
These Terms of Use ("**Terms**") govern the conditions regarding the use, access, and downloading of the CadetMind mobile application ("**Application**" or "**Service**"). The Application is developed by Cadetmind ("**Service Provider**") and is offered to end-users ("**User**" or "**You**") via the Apple App Store. By downloading, installing, or using the Application, you declare that you have read, understood, and accepted all provisions of these Terms.

## 2. NON-AFFILIATION DISCLAIMER AND TRADEMARK DISCLAIMER
### 2.1. No Official Affiliation
CadetMind is an independent educational support tool. This Application does not have any direct or indirect partnership, sponsorship relationship, official approval, or cooperation with any airline company, civil aviation authority, or examination center.
### 2.2. Trademark Usage
Trademarks such as "THY", "DLR", "PACE", "Mollymawk", and similar marks appearing within the Application and in promotional materials are used solely for informational purposes to explain the scope, purpose, and compatibility of the educational modules offered by the Application, within the framework of Article 7 of the Industrial Property Law and international "**Nominative Fair Use**" principles. The ownership of these trademarks belongs to their respective rights holders.
### 2.3. Official Information Source
The Application is not an official source of information regarding exam dates, application conditions, or exam formats. Users are obliged to follow the official websites of the relevant institutions (e.g., THY Kariyer, DLR) for current and official information.

## 3. NATURE OF THE SERVICE AND NO GUARANTEE OF RESULTS
### 3.1. Educational Tool
CadetMind includes simulations and practice modules designed to help pilot candidates improve cognitive abilities such as visual memory, spatial perception, mathematical thinking, and attention.
### 3.2. No Guarantee of Success
The Service Provider does not guarantee that the use of the Application will result in success in any aviation exam (DLR, CRM, Board Interview, etc.), that a specific score will be obtained, or that a recruitment process will result positively. Exam success depends on factors external to the Application, such as the user's individual ability, study discipline, and performance at the time of the exam.
### 3.3. Content Changes
Exam formats and contents may be changed by the relevant institutions without prior notice. The Service Provider makes reasonable efforts to keep the Application content up to date but does not warrant that the contents coincide 100% with the actual exam at any given moment.

## 4. SUBSCRIPTION, PAYMENT, AND CANCELLATION (SUBSCRIPTION TERMS)
The Application offers auto-renewable subscription models to provide access to all content.
### 4.1. Subscription Packages
Subscription durations (e.g., 1 Week, 1 Month, 1 Year) and fees offered within the Application are clearly stated on the purchase screen ("**Paywall**").
### 4.2. Payment
When you confirm the purchase, payment will be charged to your Apple iTunes Account (Apple ID). Prices include all applicable taxes (VAT, etc.) based on your country or region.
### 4.3. Auto-Renewal
Your subscription automatically renews for the selected package duration and at the then-current fee unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged within 24 hours prior to the start of each renewal period.
### 4.4. Subscription Management and Cancellation
You can manage your subscriptions and turn off auto-renewal by going to Apple Account Settings (Settings > Apple Account > Subscriptions) after the purchase. Direct cancellation or refund processing cannot be performed via the Application interface. The cancellation becomes effective at the end of the current billing period.
### 4.5. Free Trial
If a free trial period is offered and the user purchases a paid subscription before the trial period ends, the unused portion of the trial period will be forfeited. Subscriptions not canceled at the end of the trial period automatically convert into a paid subscription.
### 4.6. Restore Purchases
When you delete the Application or switch devices, you can define your previously purchased active subscription to your new device via the "**Restore Purchases**" button without paying an additional fee. This process is performed via Apple ID verification.

## 5. TECHNICAL INFRASTRUCTURE AND DATA PRIVACY (SUPABASE & REVENUECAT)
### 5.1. Data Processing and Storage
The Application uses the Supabase infrastructure for user account management and authentication operations. User data (email, username, etc.) is stored in encrypted form on Supabase's secure servers. The Application does not record or store users' exam scores, test results, or performance data on the server side; this data is only shown to the user instantly during the relevant session. The User gives explicit consent for their account data to be processed on these servers (including those abroad) for the performance of the service.
### 5.2. Subscription Verification
Subscription status and purchase history are verified through the RevenueCat platform. RevenueCat tracks users via anonymized identities (App User ID). Neither the Service Provider nor RevenueCat views or stores your credit card number or payment passwords; this data is processed solely by Apple.

## 6. INTELLECTUAL PROPERTY AND LICENCE
### 6.1. Ownership
The source codes, visual designs, question bank, algorithms, and the "**CadetMind**" brand of the Application are the exclusive property of the Service Provider.
### 6.2. Right of Use
The User is granted a limited, non-transferable, non-sublicensable right of use to use the Application solely for personal and educational purposes. Copying, reproducing, sharing on public platforms, or subjecting the Application content to reverse engineering is strictly prohibited.

## 7. LIMITATION OF LIABILITY
### 7.1. Indirect Damages
To the maximum extent permitted by law, the Service Provider shall not be held liable for loss of profit, loss of data, exam failure, loss of career, or other indirect damages, regardless of whether based on contract, tort, or any other legal theory.
### 7.2. Service Interruptions
The Service Provider is not liable for temporary interruptions that may occur in access to the Application due to technical maintenance, updates, or force majeure.

## 8. GOVERNING LAW
This Agreement is subject to the laws of the Republic of Türkiye. In case of dispute, Istanbul Courts and Enforcement Offices are authorized.
